Good question. I would think not unless you no for a fact that they are under age. Lets face it, the children today do not look or act their age. Now I'm not taking the side of the accused but if the victim lies and the accused clearly sees and adult then maybe the victim should share some of the blame. There are 15 and 16 year olds that look and act like they're in their early 20's and some look and act even older. If the victim knew lying about their age was wrong then they had the opportunity to stop it just as well. I know some may not agree but it is what it is. I do not support rape by no means but if they can lie then they know what they are doing.
